1) THIS IS AN AGREEMENT BETWEEN YOU AND UKANON.ORG
This is an agreement ("Agreement") between you and ukanon.org. This Agreement governs your use of any web site, web page or web service operated by ukanon.org. You acknowledge that you are at least 18 years of age and have attained the age of majority in the country, province, state or county in which you reside, and any information that you submit is correct.
UKANON.ORG OFFERS THE UKANON.ORG SERVICE TO YOU CONDITIONED ON YOUR ACCEPTANCE WITHOUT MODIFICATION OF THIS AGREEMENT. YOUR USE OF THE UKANON.ORG SERVICE CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT. THIS AGREEMENT CONTAINS DISCLAIMERS OF WARRANTIES AND LIABILITY (See below)
2) HOW UKANON.ORG MAY MODIFY THIS AGREEMENT
ukanon.org reserves the right to change the terms, conditions, and notices under which it offers the Ukanon.org service. You are responsible for regularly reviewing these terms, conditions and notices, and any additional terms posted on any ukanon.org website. Your continued use of the ukanon.org service after the effective date of such changes constitutes your acceptance of and agreement to such changes.
3) NO COMMERCIAL, UNLAWFUL OR HARMFUL USE OF UKANON.ORG SERVICES
The ukanon.org service is intended solely for your personal use. You will not use the ukanon.org service for commercial purposes - including but not limited to, sending commercial email solicitation and/or advertisements. You will not use the ukanon.org solution in any way that is unlawful, criminal, or harms ukanon.org, its affiliates, resellers, distributors, service providers and/or suppliers (each, a "ukanon.org Party" and collectively, the "ukanon.org Parties") or any customer of a ukanon.org Party, as determined at ukanon.org's sole discretion. You will not use the ukanon.org services to harass or threaten any other party. You will not use the ukanon.org Services to crash, slow, or intentionally harm any computer system. You may not use the ukanon.org service in any way that breaches any code of conduct, policy or other notice applicable to the ukanon.org service. You will not use the ukanon.org Service to obtain unauthorised access to any computer system. Without limiting the generality of this section, you may not use the ukanon.org service in any manner that could damage, disable, overburden, or impair any computer system or ukanon.org web site (or the network(s) connected to any ukanon.org web site) or interfere with any other party's use and enjoyment of the ukanon.org service.
4) DISALLOWED USES OF UKANON.ORG SERVICES
By using the ukanon.org Service, you agree to be bound, without any limitation or qualification, by the following Policies -
a) You agree not to use the Service to carry out unlawful activities.
b) You agree not to use a robot, such as ReGet, GetRight, Go!Zilla, or any similar programs, to download content continuously in an unattended or attended basis. WARNING - see bandwidth restrictions.
c) ukanon.org is not responsible in anyway for any damages or losses, either directly or indirectly, arising from your use of the service, or by your inability to use the Service.
d) You agree that you will not use the Service to:
i/ harass, threaten, or abuse others.
ii/ invade the privacy of others.
iii/ infringe the copyright and/or intellectual properties of others.
iv/ impersonate another person or entity.
v/ SPAM the Internet.
vi/ do anything illegal.
The Service is provided "as is". There is no warranty, expresses or implied, of any kind. ukanon.org does not warrant that the contents retrieved through the Service are error free. ukanon.org reserves the right to take whatever actions ukanon.org deems appropriate to enforce ukanon.org's policies including, but not limited to Terms of Use and Notices. ukanon.org also reserves the right to change ukanon.org policies without prior notice at any time. The actions ukanon.org takes may include suspension or termination of the service for the customer. ukanon.org does NOT issue credits or refunds for accounts cancelled or suspended due to policy violations. ukanon.org reserves the right to refuse service to anyone at anytime for any reason.
5) ACCOUNT INFORMATION
Passwords - ukanon.org provides anonymity and therefore keeps as little information as possible on our customers. Your passwords are only stored on our servers in encrypted form and are not accessible to our support staff. It is therefore highly recommended that you record your username and password in a secure place for future reference. Our staff are trained to never request a password via e-mail or telephone. If you lose or cannot remember your password then this can be reset by the system on-line - it will NOT be emailed to you.
Refunds - Refunds will only be given within 10 days of purchase of ukanon.org software and services. Refunds will only be given by contacting us here. This policy is necessary to prevent users from obtaining services for the sole purpose of abusive use as outlined above, and then canceling the account after unlawful or malicious acts have been carried out.
Renewals - You will be notified within 4 weeks of the expiry of your subscription to renew.
All aspects of account management are dealt exclusively through the ukanon.org website.
6) SERVICE ABUSE
To the maximum extent permitted by applicable law, ukanon.org may disclose such information in the event it has a good faith reason to believe it is necessary for purposes of ensuring your compliance with this Agreement, and protecting the rights, property, and interests of the ukanon.org Parties or any customer of a ukanon.org Party or where ukanon.org is requested by any law enforcement agencies.
7) UKANON.ORG MAKES NO WARRANTY
UKANON.ORG PROVIDES THE UKANON.ORG WEBSITE "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE," AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE UKANON.ORG PARTIES MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. THE UKANON.ORG PARTIES DISCLAIM ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY AND IMPLIED, INCLUDING WITHOUT LIMITATION
(a) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, ACCURACY, TITLE, QUIET ENJOYMENT, NO ENCUMBRANCES, NO LIENS AND NON-INFRINGEMENT
(b) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE
(c) WARRANTIES OR CONDITIONS THAT ACCESS TO OR USE OF THE UKANON.ORG web SITES WILL BE UNINTERRUPTED OR ERROR-FREE. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE FACE OF THIS AGREEMENT.
8) LIABILITY LIMITATION
IN NO EVENT WILL ANY UKANON.ORG PARTY BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM THIS AGREEMENT OR YOUR USE OF THE UKANON.ORG SERVICE, EVEN IF SUCH UKANON.ORG PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE EXCLUSION OF DAMAGES UNDER SECTION 10 IS INDEPENDENT OF YOUR EXCLUSIVE REMEDY AND SURVIVES IN THE EVENT SUCH REMEDY FAILS OF ITS ESSENTIAL PURPOSE OR IS OTHERWISE DEEMED UNENFORCEABLE. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM
(1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) NEGLIGENCE, OR (4) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU ARE DISSATISFIED WITH THE UKANON.ORG SERVICE, YOU DO NOT AGREE WITH ANY PART OF THIS AGREEMENT, OR YOU HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST ANY UKANON.ORG PARTY WITH RESPECT TO THIS AGREEMENT OR THE UKANON.ORG SERVICE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE UKANON.ORG SERVICE. 9) CHANGES : ADDITIONAL LIABILITY LIMITATION THE UKANON.ORG PARTIES MAY CHANGE THE UKANON.ORG SERVICE OR DELETE FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON. As you use the ukanon.org Service, you should expect to receive, access or use information, materials, graphics, software, data and content (collectively, "Content") originated by ukanon.org and persons other than ukanon.org (any such person is referred to as a "Third Party"). YOU ACKNOWLEDGE AND AGREE THAT THE UKANON.ORG PARTIES ARE NOT RESPONSIBLE OR LIABLE FOR
(a) ANY CONTENT, INCLUDING WITHOUT LIMITATION, ANY INFRINGING, INACCURATE, OBSCENE, INDECENT, THREATENING, OFFENSIVE, DEFAMATORY, TORTIOUS, OR ILLEGAL CONTENT
(b) ANY THIRD PARTY CONDUCT, TRANSMISSIONS OR DATA. IN ADDITION, YOU ACKNOWLEDGE AND AGREE THAT UKANON.ORG IS NOT RESPONSIBLE OR LIABLE FOR
(1) ANY VIRUSES OR OTHER DISABLING FEATURES THAT AFFECT YOUR ACCESS TO OR USE OF THE UKANON.ORG WEBSITE
(2) ANY INCOMPATIBILITY BETWEEN THE UKANON.ORG websiteS AND OTHER WEBSITES, SERVICES, SOFTWARE AND HARDWARE
(3) ANY DELAYS OR FAILURES YOU MAY EXPERIENCE IN INITIATING, CONDUCTING OR COMPLETING ANY TRANSMISSIONS OR TRANSACTIONS IN CONNECTION WITH THE UKANON.ORG WEBSITE IN AN ACCURATE OR TIMELY MANNER
(4) ANY DAMAGES OR COSTS OF ANY TYPE ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF ANY SERVICES AVAILABLE FROM UKANON.ORG OR THIRD PARTIES THOUGH LINKS CONTAINED ON THE UKANON.ORG WEBSITE. THE LIMITATIONS ARE NOT INTENDED TO DEPRIVE YOU OF ANY MANDATORY PROTECTIONS PROVIDED TO YOU UNDER APPLICABLE LAW. 10) LOGFILES AND BANDWIDTH USAGE The ukanon.org Service shall retain, for a period of one month, system log files that record the bandwidth usage per day of each subscriber. Subsequently the ukanon.org Service shall keep summary data per day of each subscriber i.e. total bandwidth used on a particular day. A subscription pertains to a maximum of 20GB (Gigabytes) of bandwidth per month - additional usage is chargeable according to current rates and payable within 48 hours of notification. Failure to pay the bandwidth charges within the allotted time may lead to the account being suspended. 11) TERMINATION ukanon.org may terminate this Agreement, or terminate or suspend your access to the ukanon.org service at any time, with or without cause, with or without notice. Upon such termination or suspension, your right to use the ukanon.org service will immediately cease. 12) COPYRIGHT AND TRADEMARK NOTICES : OTHER ACKNOWLEDGEMENTS
